Recreational Marijuana Information

On July 1, 2015, recreational marijuana becomes legal in the state of Oregon. While the Oregon legislature is still in the process of working out the details, there are some questions that can be answered now.

When does recreational marijuana use become legal in Oregon?

How old do I have to be?
You must be age 21 or older to possess or consume marijuana  for recreational purposes. If you are under 21, you still cannot possess or consume marijuana.

Where can I use (smoke, eat, drink) marijuana?
You can use marijuana in a private residence.

Where is marijuana use prohibited?
It is unlawful for any person to use marijuana in a public place. Violators are subject to citation and seizure of their marijuana product.

Public consumption of marijuana is a Class B Violation.

What can I carry on my person?
An adult age 21 or older can carry up to one ounce of usable marijuana on their person. Possession of more than one ounce  is a Class B violation.

How much can I have at home?
One household, regardless of number of residents, can legally have:
  • 8 ounces of usable marijuana
  • 4 plants
  • 16 ounces of solid homemade marijuana products
  • 72 ounces of liquid homemade marijuana products

What is usable marijuana?
Usable marijuana means dried marijuana flowers and dried marijuana leaves, and any mixture thereof.

What is the definition of public?
Public place is defined as: A place to which the general public has access and includes, but is not limited to, hallways, lobbies and other parts of apartment houses and hotels not constituting rooms or apartments designed for actual residence, and highways, streets, schools, places of amusement, parks, playgrounds and premises used in connection with public passenger transportation. 

Place where general public has access is interpreted to prohibit use of marijuana in restaurants and bars. 

Can I use marijuana while driving?
No. Use of marijuana in a vehicle is prohibited. Driving Under the Influence of Marijuana remains illegal.

Can I give or receive marijuana?
Yes, if you are age 21 or older you can receive or give marijuana to another person age 21 or older.

Can I sell marijuana?
No, this remains a felony until at least January 1, 2016, when recreational sales become legal in Oregon. The rules for sales of recreational marijuana are still under review at the state level.
