[ARCHIVED] Updates to City Code Support Accessory Dwelling Unit Development ADU Land Use Code Amendments

On September 15, 2021, the Eugene City Council adopted Ordinance No. 20659 to finalize compliance with state law for Accessory Dwelling Units (ADUs). Council's action also included approval of five motions which further removed barriers and increased opportunities for ADU development. These changes went in effect on September 17, 2021. The changes are briefly summarized below:

  • Allows, where not previously allowed, an accessory dwelling for each single-family dwelling allowed by the code, including on alley access lots and flag lots.
  • Increases the allowed height of an ADU to 25 feet, allows ADUs above a garage, and increases the height for ADUs on sloped lots.
  • Increased the height of sloped setbacks and removed sloped setback requirements along rights-of-way.
  • Removes regulations that: include accessory dwellings in maximum density calculations; prohibit ADUs based on lot area or lot dimensions; and limit the number of people that can occupy an accessory dwelling or a property that includes an ADU.
  • Eliminates on-site parking requirements, owner occupancy requirements, wall length development standards, and garbage screening for ADUs.
